GDPR: A Legal Interpretation for Higher Education

Adopted by the European Parliament in April 2016, the General Data Protection Regulation (GDPR) significantly expands personal privacy rights for EU residents and expands beyond the enforcement of its predecessor, the Data Protection Directive (DPD), by reaching to entities with no physical EU presence. Enforceable in May 2018, non-compliant institutions face substantial fines. 

Webinar 2 of 3 on GDPR will follow-up on the questions presented by attendees of Webinar 1. It will also take a legal look at the regulation and provide insight into the affected university systems relevant to AACRAO members.

Presenter: Heidi Wachs, Special Counsel, Jenner & Block

Heidi L. Wachs is a member of Jenner & Block's Privacy and Information Governance Practice. A nationally recognized leader in privacy, breach response and data security compliance, her wealth of experience includes serving as a privacy researcher and as chief privacy officer of a major university. Ms. Wachs is a certified information privacy professional.

Ms. Wachs also supports the firm’s growing cybersecurity and education industry practices. She counsels clients on facilitating collaboration among in-house legal, risk, audit, and technical operations to create comprehensive policies and procedures around the use of all types of data.

Presenter: Bret Cohen, Partner, Hogan Lovells

Bret Cohen helps educational institutions, technology companies, and brick-and-mortar businesses comply with privacy, cybersecurity, Internet, and consumer protection laws. With a particular focus on the Internet and e-commerce, Bret has advised extensively on legal issues related to data governance, cloud computing, social media, mobile applications, online tracking and analytics, and software development. He counsels and is a frequent speaker on strategic compliance with global privacy laws, such as the EU General Data Protection Regulation, including on topics such as cross-border transfer restrictions, data localization requirements, and government surveillance and requests for information. 

Presenter: Mark McConahay, Vice Provost and Registrar at Indiana University - Bloomington

Mark McConahay, Vice Provost and Registrar at Indiana University - Bloomington; Mark attended Indiana University in Bloomington, Indiana, received a B.A. in Mathematics (1979) and Master of Science of Environmental Science (1984) and never left. He joined the Office of the Registrar in 1982 as an Analyst/Programmer, was the Associate Registrar of Systems from 1990-2011, and is now the Associate Vice Provost and Registrar. In addition to his work in the Office of the Registrar, Mark has presented at several conferences, received two EDUCAUSE Best practice Awards (then CAUSE), two CUMREC Best Paper Awards, contributed to books and articles, was a member of the 2002 EDUCAUSE program committee, and a member of the CUMREC Board of Directors.

Julia Funaki joined AACRAO in 1996, after working in international admissions and education services at American University, Ohio Wesleyan University and the University of Maryland at College Park.  She has been involved with NAFSA, AACRAO, TAICEP and other organizations, as author, presenter, committee member and chair. Julia serves on the faculty for the AACRAO Summer and Winter Institute.
