The IRS proposed a rule that would revoke an institution’s non-profit status if they “favor certain racial preferences in admissions, facilities, programs, scholarships, and financial assistance.” American higher education has served as an engine of progress throughout our nation’s history and the proposed rule directly threatens this. Not to mention, it almost certainly exceeds the IRS legal authority. Section 501(c)(3 ) states that “[c]orporations . . . organized and operated exclusively for religious, charitable . . . or educational purposes” “shall be exempt from taxation.” AACRAO joined over 40 higher education groups in sending a community letter strongly objecting.
