Judge Signals Skepticism Toward Trump Administration’s National Security Case for Visa Cuts

U.S. District Judge F. Dennis Saylor pushed back against the Trump administration’s new restrictions on F, J, and I visas during a court hearing on September 3, 2026, telling government lawyers the potential harm from the changes was “enormous” and questioning the evidence behind the administration’s national security rationale. The Department of Homeland Security rule, set to take effect September 15, adds new barriers for students seeking to study in the U.S.. The lawsuit was brought by The NewsGuild-CWA, NAFSA, the Presidents’ Alliance on Higher Education and Immigration, the American Federation of Teachers, and several other unions and higher ed groups. Plaintiffs’ attorneys argued the shortened renewal clock would severely disrupt international students and researchers who have leases, children in school, and family ties built around longer stays. The judge said he was considering a temporary restraining order to buy more time before ruling.
